Project Design and Development Contract

This Agreement is entered into by and between XXXXX, (hereinafter “Client”) and CURRENT ELECTRIC Contracting and Design, Inc., a California corporation.  The effective date of this agreement is XXXXX, 2000.

This agreement is for the design/build of the XXXXX Residence located in the city of XXXXX, at XXXXXXXX. Due to policy restrictions this is an inclusive contract for design and build.  Design fees are quoted below.  Build fees will follow as an amendment to the contract.  Further, it is agreed that the plans created under this agreement are the property of CURRENT ELECTRIC Contracting and Design, Inc.

The parties hereby agree as follows:

CURRENT ELECTRIC Contracting and Design, Inc. will provide two sets of plans containing:

·         Control Diagrams

 

·         Equipment and Conduit Locations

·         AV locations and wiring

Meetings and Submittals:

·         Owners Meetings ( 2 within 1 week)

·         Owners Revisions ( 2 within 1 week)

·         Preliminary Plan Submittal  (1 within 2 weeks)

·         Plan Revision Submittal (2 within 1 weeks each)

 

Miscellaneous Provisions:

·          The contents of this agreement were discussed and accepted XXXXXX, 2000 via telephone conversation by all parties involved. Parties present were XXXXXXX, client and Harry Grace of CURRENT ELECTRIC Contracting and Design, Inc.

·          Any and all design deficiencies discovered by CURRENT ELECTRIC Contracting and Design, Inc. or the governing Building Authorities shall not be the responsibility of CURRENT ELECTRIC Contracting and Design, Inc.

·          Client shall pay any and all fees required by governing Building Authorities.

·          Any fees paid by CURRENT ELECTRIC Contracting and Design, Inc. shall be billed to the Client at cost plus 15% handling.

·          Attachments outline rates and conditions.  We anticipate design and development will take approximately 20-25 hours.

Compensation:

In consideration for the services required of CURRENT ELECTRIC Contracting and Design, Inc. hereunder, Client agrees to compensate CURRENT ELECTRIC Contracting and Design, Inc. as follows:

·         Upon Acceptance of Agreement

50%

·         Upon Submittal

25%

·         Upon Approval and Return

25%

·         As much as 30% of these costs may be absorbed upon acceptance of the resulting construction proposals.

 

 

Complete Agreement of the Parties: 

This is the complete agreement of the parties and it supersedes any agreement that has been made prior to this agreement.  A competitive bid may be issued to agreed and qualified similar contractors.  However, CURRENT ELECTRIC Contracting and Design, Inc. reserves the opportunity for a last look option and negotiation.
